Schiff & Hulbert Wins Dismissal of Sexual Harassment Suit
Against Dental Practice.

Schiff & Hulbert won a Motion to Dismiss a sexual harassment case brought by a former office manager against a dental practice. A careful analysis of the number of employees demonstrated that the client did not employ 15 or more employees for 20 or more weeks. Therefore, the plaintiff could not prove the practice was an employer under Title VII. The dismissal saved the client the expense of preparing a Summary Judgment Motion, trial, possible compensatory and punitive damages and plaintiff’s attorney’s fees.


Schiff & Hulbert Wins Summary Judgment on Age Discrimination.

Schiff & Hulbert won a Summary Judgment on behalf of a cleaning contractor on an ADEA case. The janitor was a poor performer. The customer complained about his work and he was provided additional training. He was reprimanded for failing to meet expectations and eventually discharged. He sued alleging his age was the true reason. Our Motion for Summary Judgment was granted saving our client the cost and risk of trial.

at Illinois Human Rights Commission.

Schiff & Hulbert won dismissal of a discrimination charge at the Illinois Human Rights Commission. The complainants were a husband and wife employed by a printing plant. The husband alleged age and marital status discrimination as well as retaliation. The wife alleged sexual harassment, marital status discrimination, and retaliation. Our investigation revealed that the wife was the instigator of the harassment. Her husband was a supervisor who tried to intimidate witnesses, which resulted in his termination. The Commission held there was no issue of fact and dismissal was granted. This saved our client the costs and risk of trial.
